Mothers’ Rights in Child Custody

After the divorce if finalized, the issue with child custody is handled. Courts generally prefer that the parents agree to have joint child custody of children. Mothers, unless found unfit, usually share physical child custody and legal child custody with the biological father.

Typically in joint custody situations, children may live in either parent’s home, but they will have liberal visitation with the other. In this situation, parents agree to work together and consult each other in making major decisions regarding the child’s life.
